HOUSES OVERSEAS –   The Legal Issues Involved and How to Solve Them When Buying Houses Overseas 

 

Many people want to purchase houses overseas but do not understand the legal issues involved. It will not be easy but it will be fun.  Before you can look at the legal issues you must decided where you want to live.  So I will assume you are going to visit several possible choices.  The best candidates in this economy could be Ccentral America – Panama, Costa Rica, or Europe – Spain, Poland, or even some of the more challenging locations like South Amererca or Asia.  Remember we are focusing on locations with relatively easy ownership requirements AND substantially reduced pricing – either due to the worldwide recession or the strength of the monetary conversion from your home currency to the new currency.  Buying houses overseas fat  reduced prices can be the answer to your new retirement problems.

You will learn  to examine what you want from a legal and price perspective.  The legal issues are sometimes general in nature, but many times specific to the country.  For example, are you buying or leasing? Will you need a loan from a local bank ? Title to property can be tricky too.  You need to buy where the locals find good value.  In these current times, many countries have property values which are taken a substantial beating from the worldwide recession and therefore value can be had.  It is important to know the legal documents, legal obstacles and what to do when they arise.  Do you need a local attorney ?How to you find one ? What should it cost ?  What legal form can I buy a property in a particular country ?  Do I owe the land, the building or the home or is it a long term lease?  All these questions and many more need to be answered before you even begin to put money into a foreign   cournty.  Remember, you are not even a resident of your new country, yet.  Caution and slow steps are the name of the game.

What are property taxes, local taxes, what about HOA’s , do you need and can you use an escrow ?  Thuose and many more questions will be answered. International living is wonderful but requires some serious examination of what is involved legally in living abroad.

The answers are generally yes and we will look at two different countries for examples.  One is Costa  Rica: A popular choice for many Americans.  Spain will be the other country that will be explored. 

The economy of each has played a big part on how the prices have been effected.  We need to look at the historical trends to determine if buying now or in a different location is best for you.  What is the increase or loss of the property value in the last several years and what lies ahead.
